Decree 30/2026/ND-CP Guiding the Law on Economical and Efficient Use of Energy
On January 21, 2026, the Government issued Decree 30/2026/ND-CP, detailing the implementation of the Law on Economical and Efficient Use of Energy. The Decree takes effect from the date of signing and replaces Decree 21/2011/ND-CP.
This Decree establishes an important legal framework to strengthen governance and promote energy efficiency (EE) practices among enterprises in Vietnam.
Key Energy Users (KEUs)
The Decree maintains the annual minimum energy consumption threshold used to determine Key Energy Users (KEUs). However, a notable update clarifies the scope of energy sources included in the total energy consumption calculation.
Provincial People’s Committees must issue the official list of KEUs before March 31 each year.
Stricter Requirements for Energy Audit Organizations
The Decree specifies detailed requirements for energy audit organizations, including: technical capacity and human resources; requirements for measuring instruments and equipment; measurement and assessment procedures; and competency assessment requirements for energy auditors.
The Decree also provides for procedures for the publication of eligible energy audit organizations on the website of the Ministry of Industry and Trade (MOIT), as well as their annual reporting obligations.
Expansion of energy labeling to vehicles and construction materials
The Decree expands mandatory energy labeling to transport vehicles and construction materials. It also adds a new category — “energy label for vehicles” — increasing the total to three types including Comparative label; Endorsement label; Vehicle energy label. Definitions and classification criteria for each label have been updated.
Responsibilites of Enterprises
- Submit energy labeling registration dossiers to the competent Ministry.
- Manufacturers and importers of regulated products must submit annual reports to Provincial People’s Committees before March 31 of the following year.
- Enterprises that have registered energy labels must report annually to the relevant Ministry before March 1 of the following year.
Expanded Incentives for Promoting Economical and Efficient Use of Energy
The Decree strengthens financial support mechanisms through the Energy Efficiency Promotion Fund to support energy-saving investment projects; encourage ESCO business models; Promote voluntary energy efficiency agreements. This creates opportunities for enterprises to access preferential financing and government support.
Transitional Provision
Energy management certificates issued before January 21, 2026 remain valid until December 31, 2030.
Conclusion
Decree No. 30/2026/ND-CP establishes a clearer and more rigorous compliance framework for energy efficiency in Vietnam. Enterprises are advised to review their status as Key Energy Users; standardize energy labeling documentation; monitor reporting deadlines; and leverage available financial incentives in order to mitigate legal risks while optimizing long-term energy costs and operational efficiency.
