On April 1, 2026, the Government issued Decree No. 112/2026/ND-CP regulating the international transfer of greenhouse gas (GHG) emission mitigation outcomes and carbon credits.
The Decree establishes a legal framework for enterprises to participate in the international transfer of emission reduction outcomes, while ensuring the fulfillment of national commitments under the Nationally Determined Contribution (NDC). 

Provisions for International Transfer Ratios

A key provision of the Decree is the regulation of transfer ratios applicable to emission mitigation outcomes and carbon credits. The maximum proportion eligible for international transfer for a given mitigation outcome generation period is stipulated as follows:

  • Priority measures and activities eligible for international transfer with corresponding adjustments under List 01, Appendix I: up to 90%
  • Encouraged measures and activities eligible for international transfer with corresponding adjustments under List 02, Appendix I: up to 50%
  • International transfer without corresponding adjustments: up to 90%

Procedures for International Transfer

The Decree sets out comprehensive procedures for implementing international transfer activities under Article 6.2, the Article 6.4 mechanism, and independent carbon standards. Key procedures include:

  • Project registration
  • Amendments to project activities or changes in participating entities
  • Issuance, recognition, and registration of GHG emission reduction outcomes and carbon credits
  • Approval for international transfer
  • Revocation of registration approval
  • Transfer of credits to Vietnam

In addition, the Decree provides procedures for requesting approval for international transfers to support emission reduction targets under international treaties and commitments.

Effective Date

  • The Decree takes effect from May 19, 2026
  • Abolition of certain clauses of Article 20a of Decree No. 06/2022/ND-CP (as amended by Decree No. 119/2025/ND-CP):
    • Clause 2 on procedures and processes for approving programs and projects registered under the Article 6.4 mechanism;
    • Clause 4 on procedures and processes for approving the international transfer of carbon credits and GHG emission reduction outcomes;
    • Clause 5 on notification of project approval status and implementation to the MAE;
    • Clause 6 on GHG emission reduction measures and activities encouraged.

Conclusion
Decree No. 112/2026/ND-CP enables enterprises to better orient their strategies and focus resources on high-impact GHG mitigation measures when participating in international carbon markets. By clarifying transfer ratios and procedural requirements, the Decree enhances business proactiveness, supports the effective utilization of carbon credit opportunities, and contributes to the achievement of national emission reduction targets.
