National Assembly Passes the Revised Chemical Law 2025: Key New Regulations Introduced

On June 14, 2025, the National Assembly officially passed the Revised Law on Chemicals with an approval rate of 92.47%. The new law comprises 7 chapters and 48 articles, reducing 4 articles compared to the draft submitted on May 8, 2025. It will officially take effect on January 1, 2026, replacing the existing 2007 Law on Chemicals (No. 06/2007/QH12). 

 

Key Updates in the 2025 Chemical Law 

■ Expanded List of Prohibited Acts 

Compared to the 2007 Law on Chemicals, which listed 4 prohibited acts, the 2025 revision expands this number to 7 prohibited acts, with more explicit and detailed legal language. Chemical manufacturers, traders, and users must pay close attention and strictly avoid the following violations: 

  • Failure or intentional refusal to provide complete, timely, or accurate information regarding: 

  • The hazardous properties of chemicals; 

  • Products or goods containing hazardous chemicals; 

  • Loss or leakage of hazardous chemicals; 

  • Chemical-related incidents or emergencies. 

  • Use of chemicals with unidentified origin, or use of chemicals that are not approved for: 

  • Food production and processing; 

  • Pharmaceuticals and cosmetic manufacturing; 

  • Animal feed, aquaculture feed; 

  • Pesticides, fertilizers; 

  • Consumer chemical products. 

 

■ Introduction of a New Concept: "Chemicals Requiring Special Control" 

A notable highlight of the 2025 revision is the official introduction of the term “chemicals requiring special control” (hóa chất cần kiểm soát đặc biệt), which replaces the older concept of “restricted chemicals for production and trade.” The new term broadens the scope of regulatory oversight. 

Enterprises using chemicals requiring special control are mandated to declare the chemical name and intended use via the centralized system prior to initial use or before any change in intended use. 

In addition, the revised law retains the existing classification of “conditional chemicals for production and trade”, as previously defined. 

 

■ National Chemical Database Upgraded to Specialized Database 

The former National Chemical Database ( sở dữ liệu hóa chất quốc gia) has been upgraded to a Specialized Chemical Database, serving as a critical platform for: 

  • Centralized management of data related to chemicals, the chemical industry, and chemicals in consumer products; 

  • Integration of both domestic and internationally recognized chemical lists accepted by the Vietnamese government; 

  • Continuous updates on new chemicals, chemical risks, and chemical safety assessments. 

Updating data into this system is now a mandatory legal obligation for all businesses involved in the use or trading of chemicals. 

 

Additional Important Provisions 

  • Stronger control of hazardous chemicals: Clear classification, risk assessments, and stricter control measures are introduced to protect human health and the environment. 

  • Promotion of environmentally friendly chemicals: Encouragement of green chemistry and sustainable development through eco-friendly chemical use. 

  • Accelerated digital transformation in chemical management: Enhanced data connectivity between state agencies and businesses through the upgraded national database system.
