Circular 22/2026/TT-BNNMT: Key Changes to Environmental and Climate Change Administrative Procedures in Vietnam
Overview of Circular 22/2026/TT-BNNMT
On May 19th, 2026, Ministry of Agriculture and Environment hereby issues a Circular 22/2026/TT-BNNM amending and supplementing some Circulars on reduction, delegation of jurisdiction and simplification of administrative procedures under the state management scope of the Ministry of Agriculture and Environment (MAE). This Circular comes into force from May 19th, 2026.
In these Article, Enviapac only mentions requirements related to Climate change & Environment field.
Amendments to articles of Circular No. 11/2026/TT-BNNMT related Carbon Credit and Greenhouse Gas Administrative Procedures:
Cancelling the registration of voluntary carbon credits
- The approver will be conducted by Provincial-level People's Committee rather MAE as currently.
- The account holder shall apply for cancellation of voluntary carbon credit registration to the Chairperson of the Provincial-level People's Committee.
- 02 working days for approval. Using new Form attached in Appendix II of new Circular 22/2026/TT-BNNMT
Transferring of ownership of GHG emission quotas and carbon credits outside of carbon trading system
- The approver will be conducted by Provincial-level People's Committee rather MAE as currently.
- Agencies and organizations shall submit application for transfer of ownership of GHG emission quotas and carbon credits outside of carbon trading system to the Chairperson of the Provincial-level People's Committee.
- 05 working days for processing. Using new Form attached in Appendix II of new Circular 22/2026/TT-BNNMT
These changings related to climate change come into force from August 01, 2026
Annulment of Circular No. 17/2015/TT-BTNMT providing for the formulation and implementation of projects under the Joint Crediting Mechanism (JCM) within the Vietnam-Japan cooperation framework.
New Environmental Impact Assessment Report Form
Form No. 04 in Appendix II attached to Circular No. 02/2022/TT-BTNMT, as amended by Circular No. 09/2026/TT-BNNMT, is replaced with Form No. 04 in Appendix V attached this new Circular.
Conclusion
Enterprises need new forms updated and follow new procedures as mentioned upper.
