Decision on Administrative Procedures for the Chemical Sector in Vietnam 2026

On January 18, 2026, the Ministry of Industry and Trade (MOIT) issued Decision No. 87/QD-BCT (2026). This Decision announces new, amended, supplemented, and abolished administrative procedures within the chemical sector under the management of the MOIT. The Decision took effect on the date of its signing.

This update follows the implementation of the guiding documents for the Law on Chemicals 2025, which took effect on January 17, 2026. This move provides businesses and relevant authorities with a clearer framework for restructuring administrative procedures related to chemical activities under MOIT jurisdiction.

The list of administrative procedures, detailed in Section I of the Decision, includes:

  • Newly Issued Procedures (39 procedures): 19 procedures will be processed by the Vietnam Chemicals Agency (Vinachemia) under the MOIT, while the remaining 20 will be handled by Provincial People's Committees.
  • Amended Procedures: Includes procedures for the appraisal and approval of Chemical Incident Prevention and Response Plans (conducted by the Ministry of Public Security, Ministry of National Defence, MOIT, and Provincial People's Committees) and Declarations of Imported Chemicals (conducted by the Vietnam Chemicals Agency).
  • Abolished Procedures (42 procedures): These procedures, previously regulated under Decree No. 113/2017/ND-CP, Decree No. 82/2022/ND-CP, and Decree No. 33/2024/ND-CP, are now void as the underlying regulations have expired.

Businesses may submit applications in person, online via public service portals, or by post. Note: The Declaration of Imported Chemicals must be performed entirely online through the National Single Window.

Businesses are advised to review the chemicals used in their production and trade activities to accurately identify the competent authorities for submission. Ensuring compliance with these updated procedures will help maintain seamless operations and prevent disruptions to business activities.
