On March 23, 2026, the Government issued Decree No. 83/2026/ND-CP, amending and supplementing several provisions of Decree No. 06/2022/ND-CP as amended by Decree No. 119/2025/ND-CP) on greenhouse gas (GHG) mitigation and ozone layer protection. The Decree takes effect immediately upon issuance.

The new amendments focus on simplifying administrative procedures, promoting digital transformation, and shortening processing timelines for businesses.

1. Dossier requirements for registration of controlled Substances

Under the new regulations, to prove legal entity status, enterprises are no longer required to submit certified true copies with official stamps as previously mandated. Instead, enterprises may submit certified true copies with official stamps; or an electronic copy extracted from the original register; or a certified electronic copy in cases where data cannot be accessed or is incomplete in the database system.

Processing timelines have also been shortened to 02 working days for notification of dossier validity; and 05 working days for publication of registration completion.

2. Procedures for allocation, adjustment, supplementation, and revocation of quotas for controlled substances

The time required for reviewing quota allocation, adjustment, or supplementation has been reduced to 22 working days. The time limit for notifying organizations of the results has also been shortened to 02 working days.

3. Transitional Provisions

  • Valid dossiers for registration, allocation, adjustment, or supplementation of production and import quotas for controlled substances that were submitted and received before the effective date of the Decree do not need to be resubmitted and will continue to be processed under the new regulations.
  • Dossiers submitted before the effective date but requiring amendment or supplementation must comply with the previous regulations for such amendments. Subsequent processing steps will follow the new Decree. 

Conclusion

Decree No. 83/2026/ND-CP enhances transparency and digitalization of procedures while reducing administrative processing time for registration and quota-related procedures concerning controlled substances. These changes help optimize regulatory compliance costs for businesses and minimize risks of disruption to production and business operations.
