On 30 December 2025, the Ministry of Agriculture and Environment of Viet Nam (MAE) issued Circular No. 78/2025/TT-BNNMT, amending and supplementing several provisions on the formulation, issuance of Letters of Confirmation and Letters of Approval (LoAfor Clean Development Mechanism (CDM) projects under the Kyoto Protocol. 

 

This Circular continues to further and consolidate the legal framework previously amended and supplemented by Circular No. 15/2014/TT-BTNMT, Circular No. 11/2022/TT-BTNMT, Circular No. 19/2023/TT-BTNMT, Circular No. 36/2025/TT-BNNMT, and Circular No. 39/2025/TT-BNNMT, ensuring consistency with the current regulatory and institutional context. 

 

Key amendments and supplements under Circular No. 78/2025/TT-BNNMT: 

  • Amendments to the documentation requirements and procedures for adjusting the content of LoA of CDM Project, with a focus on simplifying dossiers for project owners and shortening the appraisal, review, adjustment of contents of LoA timeline; 

  • Standardization of the names of relevant authorities referred to in the Circular, in line with the current organizational structure and state management functions. 

 

The Circular takes effect from the date of signing. For applications for adjustment of LoA of CDM project submitted to the Ministry of Agriculture and Environment prior to the effective date, the processing will continue to follow the previous regulations. 

 

Circular No. 78/2025/TT-BNNMT simplifies administrative procedures and shortens processing timelines, facilitating enterprises in participation in international carbon markets. 

 

On 31 December 2025, the Ministry of Agriculture and Environment issued Consolidated Document No. 91/VBHN-BNNMT on the development and issuance of Letters of Confirmation and LoA for CDM projects under the Kyoto Protocol. This consolidated document integrates the provisions of Circular No. 15/2014/TT-BTNMT and all subsequent amending and supplementing circulars, including Circulars No. 11/2022/TT-BTNMT, 19/2023/TT-BTNMT, 36/2025/TT-BNNMT, 39/2025/TT-BNNMT, and 78/2025/TT-BNNMT, enabling enterprises and project developers to more easily access, understand, and apply the applicable regulations. 

 

Eligible CDM projects wishing to continue generating valid credits after 2020 must be transitioned to Article 6.4 in accordance with the guidance of the Article 6.4 Supervisory Body and obtain approval for the transition to Article 6.4 from the host country (Vietnam).
