Draft Decree guiding Resolution No. 253/2025/QH15 on National energy development policies for 2026–2030

On 13 January 2026, the Draft Decree detailing the implementation of Resolution No. 253/2025/QH15 on mechanisms and policies for national energy development in the 2026–2030 period was officially released for public consultation. The Draft Decree introduces a series of important regulatory provisions and procedures aimed at promoting offshore wind power development in Viet Nam.

Conditions applicable to survey units and project developers of offshore wind power projects selling electricity to the grid

The Draft Decree supplements specific criteria on financial capacity and experience in energy project development for enterprises conducting proposals for offshore wind surveys and preparing applications for investment policy approval. These requirements are intended to ensure that offshore wind projects are implemented by investors with sufficient financial strength, technical competence, and market credibility; thereby enhancing project feasibility; improving bankability and access to project finance.  

Mechanism for handling the cost of survey and dossier preparation for investment policy approval

For cases where state-owned enterprises (with 100% state capital) are assigned to conduct surveys and prepare dossiers for investment approval but do not proceed with project implementation, or only participate as capital contributors, investors shall reimburse all or part of the survey and dossier preparation costs, in proportion to their capital contribution ratio. 

Regulations on dossier contents and procedures for investment policy approval and survey proposals

For offshore wind projects included in national planning and expected to operate in 2025 – 2030 and in 2031 – 2035, the Draft Decree further clarifies:

  • The required contents of application dossiers;
  • The procedures for receipt, appraisal, and approval of offshore wind investment policy proposals;
  • The process for reviewing survey project proposals.

The Draft also establishes a coordination mechanism among relevant authorities, contributing to greater transparency and administrative efficiency.

Overall, the Draft Decree represents an important step toward addressing regulatory gaps and inconsistencies in offshore wind power development. It is expected to facilitate greater participation by private investors; accelerate the implementation of offshore wind projects; align offshore wind development with Viet Nam’s long-term renewable energy and energy transition policy objectives.
