Promulgates Decree 105/2025/NĐ-CP on elaborating the Law on Fire and Rescue

On May 15, 2025, the Government promulgates Decree No. 105/2025/ND-CP elaborating the Law on Fire and Rescue. This new Decree comes into force from July 1, 2025. 

The following Decree expires from the effective date: 

a) Decree No. 136/2020/NĐ-CP dated November 24 of 2020; 

b) Decree No. 83/2017/NĐ-CP dated July 18, 2017; 

c) Decree No. 50/2024/NĐ-CP dated May 10 of 2024; 

d) Decree No. 78/2011/NĐ-CP dated September 1, 2011. 

Notable New Points in Decree No. 105/2025/ND-CP 

1. Regulations/ rules on fire and rescue 

According to Article 3, the internal fire prevention and rescue rules/ regulations of an establishment must include: 

(a) Regulations on management, use of electricity, fire sources, heat sources, equipment and tools producing flame, heat, combustible or flammable substances; 

(b) Regulations on the management and use of fire and rescue equipment; 

(c) Regulation on actions taken in case of fire, explosion, accidents. 

2. Fire and rescue dossiers

Fire and rescue dossiers previously guided in Circular No. 149/2020/TT-BCA is now provided in Article 4 of Decree 105/2025/ND-CP, specifying 12 basic types of documents, with additional new dossiers added. 

Documents can be stored in either paper or electronic form. 

3. List of Buildings Subject to Fire Safety Design Appraisal

Appendix III of this Decree replaces Appendix V of Decree 50/2024/ND-CP, listing buildings subject to fire safety design appraisal. 

4. Fire prevention and firefighting inspection

  • Periodic inspections: Conducted every 1 to 3 years, depending on the establishment and the authority. 

  • Unscheduled inspections: May occur in case of suspected violations, complaints, or denunciations. 

Details of inspection points are provided in Clause 1 Article 13. 

5. Monthly Self-Inspection by Establishments

All establishments are required to conduct monthly self-inspections of fire safety. 

For establishments with risk of conflagration (Appendix II) and establishments under fire prevention and firefighting management (Appendix I): 

  • Prepare self-inspection minutes using Form PC02 

  • Submit a biannual report using Form PC04 by June 15 and December 15 each year (Establishments in Appendix I submit annual report by December 15 only) 

6. Firefighting and Rescue Plans

The head of each establishment is responsible for developing and approving fire prevention and rescue plans: 

  • Use Form PC06 

  • Include contents specified in Points a) through dd) of Clause 1, Article 15. 

7. Fire and rescue team

  • Establishments under fire and rescue management (under Appendix I of  the Decree) with 20 or more regular employees: must establish an grassroots fire and rescue teams.. 

  • Fewer than 20 employees: not required to form a team but must assign personnel in writing to be responsible for fire and rescue tasks. 

8. Database on fire prevention, firefighting, rescue and fire alarm transmission

By no later than July 1, 2027, all establishments under fire prevention and firefighting management list (under Appendix I of this Decree) must be equipped with and connecting fire alarm transmission devices to database on fire prevention, firefighting, rescue and fire alarm transmission...

9. Training for fire and rescue operations

  • Fire and rescue training: Every 5 years 

  • Refresh Fire and rescue training: Conducted annually
